Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you and TextClaw concerning your access to and use of the TextClaw website, mobile application, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use our Services.

You must be at least 18 years of age to use our Services. By using our Services, you represent and warrant that you meet this age requirement.

Description of Services

TextClaw is a SaaS platform that provides AI assistants with dedicated phone numbers. Users can sign up, provision an AI agent with a Twilio-powered phone number, and communicate with it via text message directly or through group chats. The AI assistant processes messages and provides intelligent responses using large language model technology.

Intellectual Property Rights

Unless otherwise indicated, the Services and all content, features, and functionality (including but not limited to all information, software, text, displays, images, and the design, selection, and arrangement thereof) are owned by TextClaw, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are granted a non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes only. Any commercial use of the Services requires prior written permission from TextClaw.

User Responsibilities

By using our Services, you agree to:

• Provide accurate, current, and complete registration information
• Maintain the security and confidentiality of your account credentials
• Accept responsibility for all activities that occur under your account
• Not use automated means to access the Services without our permission
• Comply with all applicable laws and regulations
• Not engage in any activity that interferes with or disrupts the Services

Prohibited Conduct

You may not use the Services to:

• Systematically harvest or collect data from the Services
• Engage in harassment, abuse, or harmful conduct toward others
• Bypass security features or access restricted areas
• Create competing services or use the platform for unauthorized commercial purposes
• Engage in fraud, deception, or misrepresentation
• Upload or transmit viruses, malware, or other malicious code
• Violate any applicable laws or regulations

Subscriptions and Payments

Some features of our Services require a paid subscription. Subscriptions automatically renew unless canceled before the end of the current billing period. All purchases are non-refundable unless otherwise required by applicable law.

If you cancel your subscription, you will continue to have access to the Services until the end of your current billing period, after which your access will be terminated.

User Content

You retain ownership of any content you submit through the Services. However, by submitting content, you grant TextClaw a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with providing and improving the Services.

You are solely responsible for the content you submit and represent that you have the necessary rights to submit such content.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. PLUSONE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLUSONE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU HAVE PAID TO US IN THE SIX MONTHS PRECEDING THE CLAIM.

Dispute Resolution

Any disputes arising from these Terms or your use of the Services shall first be attempted to be resolved through informal negotiation for a period of 40 days. If the dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.

You agree to waive any right to participate in class action lawsuits or class-wide arbitration against TextClaw.

Termination

TextClaw reserves the right to terminate or suspend your access to the Services at any time, with or without cause or notice, at our sole discretion. Upon termination, your right to use the Services will immediately cease.

Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by updating the date at the top of these Terms and, in some cases, provide additional notice. Your continued use of the Services after any changes constitutes acceptance of the updated Terms.
